Obamacare loophole allows low-wage foreigners to enroll, but not citizens

In the many states where Medicaid has not been expanded, many low wage, part-time, or unemployed workers are finding that they do not earn enough ($11,670 for a single person) to qualify for Obamacare subsidies, but cannot get Medicaid under their state’s traditional requirements, which often require that a person have no assets.

However, there is a loophole in the Obamacare law that exempts people from the minimum income requirement provided that the person is a NON-U.S. CITIZEN, or has a non-U.S. citizen in their household. Such people would pay less that $20 per month (and potentially nothing) and receive high quality insurance (better than a Platinum plan). This is not intended for illegal aliens, as the Obamacare website requires non-U.S. citizens provide their visa data.

Still, the website often allows people to receive insurance provisionally and send in documentation within 90 days. And of course, if there were an amnesty, all illegals would gain  status and could take advantage of this provision.

U.S. citizens in the states who live in these states and don’t meet the income requirements do have a loophole that can help them, although few people know about it. If someone is optimistic that they will get a job later in the year and thus they will thus make the minimum income for the year, they can get Obamacare subsidies. However, if they do not get the minimum income by the end of the year, it is unclear whether they may have to pay back some of the Obamacare tax credits.
